2. The petitioner is apprehending his arrest in connection with Haspura P.S. Case No. 168 of 2023 for the offence under Sections 341, 323, 325, 498A and 34 of the I.P.C. and Section 3/4 of the Dowry Prohibition Act.

3. As per the prosecution story, the informant has alleged that her marriage was solemnised with the son of the petitioner in the year 2017. She further alleged that since marriage, her husband used to beat her in order to extract one car from the father of the informant. It is also alleged that the petitioner used to keep illicit relations with some other women.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. From bare perusal of the F.I.R., it appears that the same has been instituted against five accused persons including the petitioner. The petitioner happens to be father-in-law of the informant whereas marriage of the informant was solemnised with his son namely, Mukesh Paswan with Hindu rituals in the year 2017. After marriage the informant along with her husband were spending their conjugal life happily and peacefully for some time. Before the marriage of his son, petitioner along with his wife namely Kanti Devi were living separately in mess and property and as such petitioner has no concern with domestic affair of his son and daughter in law.

5. Learned APP opposes the prayer for bail.

6. During the course of argument, learned counsel for the petitioner submits that the petitioner is father-in-law and he is living separately prior to alleged occurrence. Keping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.
