Counsel for the respective parties are in agreement that since the effect of the punishment order dated 26.11.2015, to the extent it has been directed by the disciplinary authority to withhold one increment with non-cumulative effect, would be over on 26.11.2016, and the petitioner herein has become eligible for grant of 3rd M.A.C.P. with effect from 20.06.2016, the petitioner herein would be liable to be granted the said benefit w.e.f. 26.11.2016.

In view of the aforesaid, it is directed that the

Patna High Court CWJC No.10305 of 2017 (2) dt.16-04-2018 2/2 petitioner be granted the benefit of 3rd M.A.C.P. w.e.f. 26.11.2016. The writ petition is allowed to the aforesaid extent.
