JUSTICE SANDEEP KUMAR ORAL ORDER 18-10-2023 Heard learned counsel for the petitioner and Mr. Uma Shankar Prasad Singh, learned APP for the State. The petitioner seeks bail in connection with Harsidhi P.S. Case No. 470 of 2023 registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code. As per the prosecution case, two stolen motorcycles have been recovered from the possession of the petitioner. The petitioner is involved in similar cases earlier also. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. He is in jail since 24.07.2023. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

No.68233 of 2023(2) dt.18-10-2023 2/2 Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 470 of 2023.
