2. The petitioner seeks bail in connection with N.D.P.S. Case arising out of Araria P.S. Case No. 230 of 2025 registered for the offences punishable under Sections 8(c), 21(b) of the N.D.P.S. Act.

3. As per the prosecution case, petitioner and others were found dealing with smack, a raid was conducted and on search of the house of Rani Devi, recovery of 101 gram of smack was made apart from Rs. 4500/- in cash and a motorcycle.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel for the petitioner submits that the main accused Rani Devi has been granted bail by a Co-ordinate

Patna High Court CR. MISC. No.66063 of 2025(2) dt.24-09-2025 2/2 Bench of this Court vide order dated 17.09.2025 passed in Cr.Misc. No. 64997 of 2025. Learned counsel further submits that petitioner has clean antecedent and he is in custody since 10.06.2025. The petitioner undertakes to co-operate in the case/ trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (NDPS Act), Araria/concerned Court below in connection with Araria P.S. Case No. 230 of 2025 subject to condition:- The petitioner will mark his attendance at the Araria Police Station on the first and third Sunday of every month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
