2. The petitioner apprehends arrest in connection with Baisi (Distt- Purnia) P.S. Case No. 23 of 2018 dated 20.01.2018, instituted for the offence punishable under Sections 273 of the Indian Penal Code and Section 30(a)/41 of the Bihar Prohibition and Excise Act, 2016.

3. The allegation is of recovery of 114 litres foreign liquor from a Toyota Car bearing Registration No. WB02X7873.

4. Learned counsel for the petitioner submits that the

It is further submitted that nothing has been recovered either from the conscious possession or from the house of the petitioner. It is next submitted that one accused person namely, Viru Ray was arrested on the spot with illicit liquor, who disclosed the name of the petitioner and only on that basis, the petitioner has been made accused in this case. Learned counsel further submitted that the said vehicle does not belong to the petitioner. It is registered in the name of Alam Ara Khatun, R/o West Bengal. Petitioner has no concern with the said vehicle. Lastly, it has been submitted that petitioner has no criminal antecedents.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Baisi (Distt- Purnia) P.S. Case No. 23 of 2018, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Excise Court- 1st , Purnia subject to condition as laid
