2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 96, 137(2) of the B.N.S.

3. The case of the prosecution in short is that the petitioner has kidnapped the daughter of the informant for the purpose of marriage.

4. Learned counsel for the petitioner submits that during the course of investigation victim girl was recovered and given her statement under section 183 of the B.N.S.S wherein she has stated that on the pretext of going to coaching she arrived at Anugrah Narayan Railway Station booked a ticket and boarded a train to go to Gaya Railway Station where she has called the petitioner. On 20.02.2025 she solemnized marriage at Vishnupad Temple, Gaya. She has further stated that the petitioner is in a relation and they

From perusal of the para no. 42 of the case diary it is clear that date of birth of victim is 01.01.2010, it means she was about 15 years on the date of occurrence. From perusal of the para 26 of the case diary it is also clear that the victim of the case has denied her medical examination. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 22.02.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Obra P.S. Case No. 74 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Daudnagar, Aurangabad.
