The petitioner seeks regular bail in connection with Khagaul P.S. Case No. 87 of 2019 for the offence punishable under Sections 467, 468, 471, 420 and 34 of the Indian Penal Code.
The allegation is regarding the accused persons including the petitioner herein having planned to sell the land of the informant and when the informant had raised objection, the accused persons had threatened to kill him.
The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in the present case. The learned counsel for the petitioner has further submitted that though the petitioner is accused in one case, but he is on bail in
Patna High Court CR. MISC. No.80076 of 2019(3) dt.13-01-2020 2/2 the said case. It is further submitted that the petitioner is languishing in custody since 29.06.2019. Lastly, it is submitted that a general and omnibus allegation has been levelled against the petitioner herein.
Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail.
Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Danapur, Patna in connection with Khagaul P.S. Case No. 87 of 2019. (Mohit Kumar Shah, J) Tiwary/- U T
