JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 11-04-2018 The present writ petition has been filed for quashing of second auction sale notice dated 07.03.2018 published in the daily newspaper "Dainik Bhaskar" as well as "Hindustan Times" and the auction sale date fixed for auction of mortgaged property of the petitioner on 28.03.2018.
2. At the very outset, learned counsel for the respondentBank refers to paragraph 2 of the supplementary counter affidavit in which statement has been made that E-auction fixed on 28.03.2018, pursuant to the said second auction sale notice, has failed as no bidder has turned up.
3. A rejoinder to the counter affidavit has been filed on
Patna High Court CWJC No.5467 of 2018 dt.11-04-2018 2/2 behalf of the petitioner in which the aforesaid stand has not been disputed.
