JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2020 Earlier anticipatory bail application of the petitioner was permitted to be withdrawn by order dated 17.6.2019 passed in Cr.Misc.No. 64011 of 2018 in view of submission of learned counsel for the petitioner that a talk for settlement was going on between the parties.

Submission of learned counsel for the petitioner is that he is ready for settlement but opposite party No.2 is not ready for that and petitioner happens to be husband of opposite party No.2.

Heard learned APP also.

In view of above facts and circumstances, let petitioner surrender on 10.2.2020 before the court below, who

No.75730 of 2019(3) dt.29-01-2020 2/2 shall grant him provisional bail and in the meantime the court below shall issue notice to opposite party No.2-complainant and after hearing both the parties and on considering rival submissions and conduct of both parties, the learned court below shall either confirm confirm the provisional bail or cancel the bail bonds of the petitioner as it deems fit and proper.
