====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek bail in connection with Amarpur (Fullidumar) P.S. Case No. 415 of 2022 registered for the offences punishable under Sections 3 and 4 of the Explosive Substance Act and under Sections 16, 18, 20 and 38 UAPA Act.
Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and are in custody since 30.07.2022.
The informant alleges that based on secret information, he went to the house of Anil Marandi at about

On seeing the police party, Anil Marandi and his father Sanjay Marandi tried to flee, however, they were nabbed and on search of the house four pieces Chitkabar colour trousers, two ewers in which 05 kg of Ammonium Nitrate and 05 kg explosive substance used for making explosion was found along with Neo Jel emulsion explosive 625 gm and 5 pieces of detonator, it is next alleged that Anil Marandi disclosed that he is in contact with former naxalite Umesh Marandi and his father (Sanjay Marandi) along with Mithilesh and Muneshwar are part of his organization and according to plan, the recovered explosive were required for carrying out a major incident.
The learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that petitioners are father and son. It is also submitted that petitioners prior to this case never had any antecedent.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioners.
The Court, for the present, is not inclined to grant bail to the petitioners.
