The petitioner apprehends his arrest in connection with Jaynagar P.S. Case No.288 of 2022, registered for the offence punishable under sections 341, 323, 353/34 of the Indian Penal Code and 25(1-b)a, 26, 35 of Arms Act.

Allegedly, one country made pistol has been recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. No incriminating articles has been recovered from the conscious possession of the petitioner. He further

Patna High Court CR. MISC. No.66901 of 2022(2) dt.19-01-2023 2/2 submits that the petitioner has no concern with the recovered country made pistol. Petitioner has two criminal antecedent. Learned APP for the State opposed the prayer for anticipatory bail and submits that the said arms has been recovered from the house of the petitioner.

Having regard to the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. Accordingly, this application is dismissed.
