JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This application, for grant of anticipatory bail, arises out of Mohammadpur P.S. Case No. 32/2019, disclosing offences under Sections 328, 307 and 34 of the Indian Penal Code. As per F.I.R. allegation against the petitioners is that on the pretext of providing medicine, they have poisoned the informant, who is wife of petitioner no. 1, due to which, she felt nausea and started vomiting and, thereafter, she was taken to hospital. Submission of learned counsel for the petitioners is that all the allegations are false and concocted. Petitioner no. 1 is husband of the informant petitioner no. 2 is bhaisur and petitioner no. 3 is mother in law of the informant and there is matrimonial dispute

Patna High Court CR. MISC. No.62153 of 2019(2) dt.15-10-2019 2/2 between the parties and now the compromise has been reached between the parties, which will appear from annexure -2 of the petition and informant is residing in the house of the petitioners. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances and also the fact that it appears to be a matrimonial dispute and as it has been submitted by learned counsel for the petitioners that the parties have compromised their dispute, as such, this application is disposed of with direction to the petitioners to appear in the court below on 05.11.2019 along with informant, as it has been submitted that informant is residing in the house of the petitioners and the court below after verifying the above submission that compromise has been reached between the parties from the informant and if the above submission is found true the court below shall release the petitioners on bail to his own satisfaction with condition to keep the informant with full honour and dignity, otherwise the court below would be at liberty to pass any order as he deems fit and proper.
