2. The petitioner seeks bail in connection with Murliganj P.S. Case No. 04 of 2023 registered for the offence under Sections 302/120(B/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The allegation against the petitioner and 22 more accused persons is of killing the deceased at around 12 PM in the night.

4. It has been further alleged that the petitioner and all the accused were identified in the night by the family members of the deceased.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 24.07.2023 and has clean antecedent.

6. It cannot be believed that the family members

Patna High Court CR. MISC. No.69418 of 2023(2) dt.01-11-2023 2/2 will identify 23 persons at around 12 in the night while they were fleeing away after killing the deceased, therefore, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1, Madhepura in connection with Murliganj P.S. Case No. 04 of 2023.
