The petitioner is in custody since 02.08.2019 in connection with Kashichak (Sahpur O.P) P.S. Case No. 67 of 2019 for the offence registered under Sections 341, 323, 325, 308, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is case and counter case between the parties and though the petitioner has assaulted with a rod on his head but there is no repetition of blow so as to attract the provision of Sections 307 and 308 of the Indian Penal Code. It is further submitted that both the parties have received injuries and the same have been found to be simple in nature.

Considering the aforesaid facts and circumstances of

No.61894 of 2019(2) dt.14-11-2019 2/2 the case and that there is case and counter case between the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - VI, Nawada in connection with Kashichak (Sahpur O.P.)
