The petitioners apprehend their arrest in connection with Biraul P.S. Case No.305 of 2015 registered under Sections 341, 323, 324 and 379/34 of the Indian Penal Code.
The accusation is that when the informant was sitting at his door, at that time, the petitioners along with two others armed with Farsa came there and two persons caught hold of his waist. Thereafter, the petitioner no.2 caught hold of the arm of the informant and twisted the same, whereas the petitioner nos.1 and 3 twisted the Gamchcha tied on his neck. At that time, the petitioner no.2 caused cut injury at the forehead of the informant through Farsa.
Patna High Court CR. MISC. No.62445 of 2019(2) dt.17-10-2019 2/2 Thereafter, all, after entering in to the house of the informant, looted cash Rs.50,000/-, clothes, ornaments and other households articles from there.
Learned counsel for the petitioners submits that due to some dispute, the occurrence of "Maar-Peet" took place between the parties in which the petitioners' side also sustained injury regarding which on the basis of the fardbeayan of the petitioner no.2, Biraul P.S. Case No.304 of 2015 was also instituted against the prosecution party. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Biraul, Darbhanga, in connection with Biraul P.S. Case No.305 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
