The petitioner apprehend his arrest in a case registered for the offence punishable u/s 281/125(a)/125(b) of B.N.S. 2023 and u/s 7 of E.C. Act.

Police has got information that a pick-up van laden with urea has met with an accident on NH-77. The petitioner is the owner of the said pick-up van.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. It is submitted that the petitioner was neither present nor travelling with the pick-up van at the time of incident. Name of the petitioner transpired only because he is the owner of the vehicle but the same was driven by

Patna High Court CR. MISC. No.74614 of 2024(2) dt.30-10-2024 2/2 one Abhay Kumar. It is further submitted that urea which was found loaded was booked by the farmers of the Sonbarsa for their agricultural use. The petitioner has one criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case and the fact that the petitioner is only owner of the vehicle, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Sonbarsa P.S. Case No.220 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
