2. The petitioners seek bail in a case registered for the offence punishable under Sections 126(2), 115(2), 351(1), 351(2), 352, 103(1) and section 3(5) of the B.N.S, 2023.
3. Allegation against these petitioners is that they along with other co-accused persons assaulted the husband of informant, as a result of which he died.
4. Learned counsel for the petitioner submits that though there is allegation against these petitioners that they along with others assaulted the deceased, but during course of investigation, father Dhuto Sah and mother Sita Devi have stated before the IO that the deceased was patient of mental
Patna High Court CR. MISC. No.68467 of 2025(3) dt.12-11-2025 2/2 disorder and in course of scuffle, the deceased fell on the bricks due to which he died. Similarly situated co-accused Deepak Kumar has been granted bail by a coordinate Bench of this Court vide order dated 12.08.2025 passed in Cr. Misc. No. 55809 of 2025. Petitioners claim clean antecedent and they are in custody since 08.03.2025 and 06.05.2025 respectively.

Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Court of Sub-Judge VIth-cum-Additional Chief Judicial Magistrate IVth, Begusarai in connection with Sahebpur Kamal P.S. Case No. 56 of 2025.
