JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This is an application for grant of anticipatory bail in connection with Kotwali (Barari) P. S. Case No. 444 of 2019, disclosing offences under Sections 366A, 323, 34 of IPC and Section 34 of Protection of Children from Sexual Offences Act. Allegation of kidnapping the minor daughter of the informant against the petitioner and other accused persons. Submission of the learned counsel for the petitioner is that the statement of the girl has been recorded under Section 164 of Cr.P.C., in which, victim girl has not named the petitioner.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the

No.61514 of 2019(2) dt.26-09-2019 2/2 court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.D.J.-1st-cum- Special Judge, POCSO Act, Bhagalpur, in connection with Kotwali (Barari) P. S. Case No. 444 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with conduction that he has to cooperate in the investigation.
