The petitioner is in custody since 06.07.2019 in connection with Paliganj P.S. Case No. 235 of 2019 for the offence registered under Sections 25 (1-b)A/26/35 of the Arms Act.
Learned counsel for the petitioner submits that the alleged recoveries were from the house of one Ravindra Kumar and not from this petitioner. It is further submitted that the present case is a glaring example of false implication, as only on secret information, petitioner's house was raided and from his house sporting rifle was recovered which was considered to be an illegal arms though it was having a valid licence. No.61965 of 2019(2) dt.15-11-2019 2/2 submitted that earlier the petitioner was with the C.R.P.F. and had purchased the said sporting rifle while he was posted in the state of Jammu and Kashmir, in which, he has valid licence and the same was not considered at the time of seizure. It is further submitted that similarly situated co-accused persons have since been extended the privilege of bail vide order dated 15.10.2019 & 25.10.2019 passed in Cr. Misc. No. 60916 of 2019 & 65030 of 2019.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Danapur in connection with Paliganj P.S. Case No. 235 of 2019.
