JUSTICE MADHURESH PRASAD) Date : 18-04-2023 Alleging supply of defective moong bean seeds to the petitioner, the writ application has been filed as a public interest litigation seeking directions for payment of compensation to the petitioner and other farmers.

The petitioner has a direct private/personal interest, which is apparent from the prayer made in the paragraph 1 of the writ petition, whereas in paragraph 4 of the writ petition, the petitioner has stated to be having no private/personal interest with respect to the issue in the writ petition.

Patna High Court CWJC No.17704 of 2022 dt.18-04-2023 2/2 Raising of such private issues by resort to public interest litigation without specifying any details with respect to the so-called (other beneficiaries), to say the least, must be depreciated. The Court is required to ensure that such frivolous or private interests are not masqueraded as genuine claims in the garb of public interest litigation, as is sought to be done by the petitioner in this case. The Court does not incline, therefore, to proceed in the matter as a public interest litigation.

Writ petition is dismissed.
