On 10.07.2018 learned co-ordinate Bench of this Court passed the following order:- "Learned counsel for the respondent-State informs that pursuant to Clause 4A(i) of the State Litigation Policy, the Department of

Patna High Court CWJC No.10961 of 2017(8) dt.11-03-2019 2/3 Health has set up a Grievance Redressal Committee for looking into various grievances including those of the present nature.

2. Three wees time is sought to file counter affidavit on behalf of the Principal Secretary, Department of Health, Govt. of Bihar, Patna (respondent No. 11) indicating the constitution, scope and other relevant details with reference to such forum.

3. As prayed, list this matter on 01-08-2018." With reference to the aforesaid order, learned counsel for the State has drawn the attention of this Court towards Annexure-A to the counter affidavit filed on behalf of respondent no. 11. The Court has been informed by the learned counsel for the State that the grievance of the petitioner may be considered by the Grievance Redressal Committee (hereinafter referred to as 'the Committee') which has been constituted in accordance with the constitution provided in the information, a copy of which has been brought on record and is available at page 101 of the brief. The Committee is said to be headed by the Principal Secretary, Department of Health, Government of Bihar is in existence at present.

In the aforesaid view of the matter, learned counsel for the petitioner submits that the writ application may be disposed of at this stage with liberty to the petitioner to bring the entire matter to the notice of the Committee within a period of

Patna High Court CWJC No.10961 of 2017(8) dt.11-03-2019 3/3 four weeks from today. It is further submitted that the Committee may be directed to look into the grievance of the petitioner, hear the parties and pass an appropriate reasoned order within a reasonable period.

In the nature of the submissions advanced at the Bar, this writ application is being disposed of at this stage without going into the merit of the contentions of the parties with liberty to the petitioner to bring the entire matter to the notice of the Committee within a period of four weeks from today. Thereafter, the Committee shall look into the request of the petitioner, examine the same, hear all stake holders and the parties likely to be affected by the order of the Committee and pass a reasoned order within a period of 90 days from the date of receipt of the request of the petitioner. The order so passed and decision taken by the Committee shall be communicated to all concern forthwith after the decision is taken as per the directions given hereinabove.

This writ application stands disposed of.
