The petitioner seeks bail in a case instituted for the offences under Sections 413, 414, 420, 467, 468, 471, 34 of the Indian Penal Code read with sections 25(1-b)a and 26(1) of othe Arms Act.
The prosecution case in short is that one country made loaded pistol along with two motorcycles were recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.6.2019. There is no allegation of tampering of witnesses alleged against the petitioner. Patna High Court CR. MISC. No.61339 of 2019(2) dt.26-09-2019 2/2 alleged to have been recovered. The petitioner had no knowledge that the motorcycles in question are stolen property. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shrinagar (Pujaha) P.S. Case No. 34 of 2019. (Sudhir Singh, J) Pankaj/- U T
