The petitioner has prayed for bail in a case registered for the offence punishable under sections 399, 402 of the Indian Penal Code and sections25(1-b)a, 26 and 35 of the Arms Act. As per allegation in the FIR, one DBBL gun, four live cartridges of .12 bore, and one semi automatic country made pistol and four live cartridges of 7.65 bore were recovered from possession of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to earlier dispute in election of Mukhiya. The recovered incriminating articles were planted by the local police with connivance of the enemy of the petitioner, then the seizure list

Patna High Court CR. MISC. No.66009 of 2022(2) dt.24-02-2023 2/2 was prepared. It is true that petitioner is having forty two criminal antecedents but except three cases in which, he is on bail. Petitioner is languishing in judicial custody since 17.09.2021.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-IV, Jamui in connection with Jhajha P.S. Case No. 278 of 2021.
