JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bettiah Mufassil P.S. Case No. 229 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR police on information of selling of liquor raided the village and from houses of several accused persons liquor was recovered and it is alleged that from in front of house of the petitioner two bottles liquor, total 4 litres were recovered. Submission of learned counsel for the petitioner is that FIR itself shows that nothing has been recovered from his house or his possession and he has no criminal antecedent and he has falsely been implicated.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, West Champaran, Bettiah, in connection with Bettiah Muffasil P.S. Case No. 229 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
