====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for offences punishable under Sections 341, 323, 324, 307, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, on 19.02.2024, while the informant and others were on their way to immerse the idol of Goddess Saraswati at the bank of river Gandak, all the F.I.R.- named accused persons, including this petitioner, came there and started assaulting them with fists and slaps and also threatened them with dire consequences.

4. Learned counsel for the petitioner submits that the allegation of assault is general and omnibus in nature, and the injury sustained by the injured is simple in nature. A similarly situated co-accused, Rajendra Kumar, having similar and

Patna High Court CR. MISC. No.65709 of 2025(2) dt.05-12-2025 2/2 identical allegations, has already been granted anticipatory bail by this Court vide order dated 02.04.2025 passed in Cr. Misc. No. 12943 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the general and omnibus allegations and the fact that the injury sustained by the injured is simple in nature, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Court of Additional Chief Judicial Magistrate-VIII, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 34 of 2024, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
