Heard learned counsel for the petitioner and learned A.P.P for the State.
The petitioner has preferred this application for grant of regular bail in connection with Sheikhpur Sarai P.S. Case No. 04 of 2018 dated 15.01.2018 registered for the offences punishable u/ss 406, 420, 467, 468, 471, 120B read with Section 34 of the Indian Penal Code.
As per the prosecution case, some miscreants were cheating money from the people to become the agents of shopping company in lucky draw and were collecting the
Patna High Court CR. MISC. No.2546 of 2023(3) dt.27-04-2023 2/3 money, on that the police raided the place and three miscreants were apprehended who disclosed the name of the petitioner. The petitioner and others succeeded in fleeing away from the spot. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has sprung up in the confessional statement of the co-accused. The co-accused persons have already been granted bail by the Coordinate Bench vide order dated 18.11.2019 passed in Cr. Misc. No. 70231 of 2019. The petitioner is accused in six other criminal cases and he is on bail in three cases as stated in para 3 of the bail petition. The petitioner is in custody since 16.09.2022. Learned A.P.P.
for the State has vehemently opposed the prayer of bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Shiekhpura in connection with Sheikhopur Sarai P.S. Case No.

Patna High Court CR. MISC. No.2546 of 2023(3) dt.27-04-2023 3/3 remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, his bail bonds is liable to be cancelled.
