1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Sonbarsa P.S. Case no.461 of 2022, registered under sections 8, 20(b)(ii)(C) and 22 of the N.D.P.S. Act.

3. As per the prosecution case, the informant states that on being confronted, three accused persons threw away the goods they were carrying on their head and made an attempt to escape. Two accused persons including the petitioner herein were caught and a total of 105 kgs of ganja like substance was recovered.

4. It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 29.2.2024 passed in Cr. Misc. no.63627 of 2023.

No.66821 of 2025(6) dt.19-12-2025 2/3 Inspite of the petitioner having remained in custody since 17.12.2022, not having any criminal antecedent and cooperating in the trial, the trial has still not concluded. The petitioner having remained in custody for more than 3 years, he be enlarged on bail. He undertakes to cooperate in the trial and to abide by any conditions which may be laid by this Court for his release on bail.

5. The application for bail is opposed by learned A.P.P. for the State.

6. A report was called for from the learned trial Court. As per the report received contained in letter dated 17.11.2025 of the learned District and Additional Sessions Judge-II, Sitamarhi, six out of the seven prosecution witnesses had been examined and only the Investigating Officer remained to be examined. The Court is now in receipt of information from the Office of the Superintendent of Police, Sitamarhi according to which the Investigating Officer has also been examined on 5.12.2025.

7. In view of the aforesaid facts, taking into consideration the allegations against the petitioner in the F.I.R, the contents of the Forensic Science Laboratory report and especially all the witnesses on behalf of the prosecution having

8. Learned trial Court is directed to expedite the trial and conclude the same within a period of three months from the date of receipt/production of a copy of this order. (Partha Sarthy, J) avinash/- U T
