2. The petitioner apprehends his arrest in connection with Kundwa Chainpur P.S. Case No. 109 of 2025 registered under Section 30(a) of the Bihar Prohibition and Excise Amendment Act.

3. As per the first information report, on a secret information that the petitioner has stored liquor in an orchard in front of the house of one Chunni Singh, 54 liters Nepali liquor was recovered and was seized.

4. Learned counsel for the petitioner submits that the alleged seizure of liquor has been made from an orchard, which is a public place and petitioner is not related either with the seized article or the place from where the seizure is said to have been made belongs to the petitioner. 5. In view of the fact that the seizure has been made from a public place and no incriminating material is there to connect the petitioner with the alleged offence, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.3, East Champaran, Motihari, in connection with Kundwa Chainpur P.S. Case No. 109 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
