JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-10-2019 The petitioner apprehends his arrest in connection with Suryapura P. S. Case No. 121 of 2018 registered under Sections 147, 148, 323, 341, 354B and 379 of the Indian Penal Code. Allegation against the petitioner is that petitioner along with other accused persons assaulted the son of the informant and the petitioner with intention to outrage her modesty caught and pulled her.

Learned counsel appearing on behalf of the petitioner submits that there is dispute between the parties relating to passage and from perusal of the FIR, it would be evident that side of the informant was erecting a parapet in the house towards the passage of the petitioner's side. He further submits that all the accused persons have been granted bail by the court below itself except this petitioner.

No.61566 of 2019(2) dt.15-10-2019 2/2 Having regard to the submissions made by the parties and taking into consideration the fact that there is dispute of passage between the parties and both parties are neighbours as well as agnate, as such I am inclined to grant anticipatory bail to the petitioners.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. Lal Bihari Paswan, learned Judicial Magistrate, 1st Class, Bikaramganj, Rohtas in connection with Suryapura P.S.Case No. 121 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
