The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 149, 341, 323, 332, 353 and 504 of the Indian Penal Code.
As per allegation, all the F.I.R. named accused persons including this petitioner assaulted the police officials and also caused hindrance in discharge of official duties of the police personnel.
It is submitted on behalf of petitioner that there is general & omnibus allegation and no specific overt act has been alleged against this petitioner. Similarly situated co-accused Ram Babu Singh has already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 18.10.2022 passed in Cr.Misc. No. 27620 of 2022. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.267 of 2023(3) dt.13-07-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahana at Dhaka, East Champaran, Motihari in connection with Dhaka P.S. Case No. 239 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
