The petitioner is apprehending his arrest in connection with Deep Nagar P.S.Case No.230/19 , registered for offences punishable under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 06 ltrs. of liquor from the house of the petitioner. Submission of the learned counsel for the petitioner is that he has been falsely been implicated in this case, having no criminal antecedent. On the other hand the learned APP has opposed the prayer for anticipatory bail on the ground of recovery of the liquor from his house.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.62710 of 2019(2) dt.15-10-2019 2/2 circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the court below and make prayer for regular bail, which will be considered by the learned court below on its own merit and if possible to be disposed of on the same day.

With the aforesaid observation, this application is disposed of.
