2. The petitioner seeks bail in connection with Bhore P.S. Case No. 324 of 2023 registered for the offence punishable under Sections 30(a)/41(i) of the Bihar Prohibition and Excise Amendment Act, 2016.

3. As per the prosecution case, 116 litres of illicit liquor has been recovered from the Bolero vehicle.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner was not apprehended from the place of occurrence nor any thing has been recovered from his possession. The petitioner is in custody since 03.09.2023.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.68230 of 2023(2) dt.18-10-2023 2/2 regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge-II-cum-Special Judge Excise-I, Gopalganj in connection with Bhore P.S. Case No. 324 of 2023.

7. The petitioner will also mark attendance in Bhore Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
