2. The petitioner is in custody since 30.07.2023 in connection with Beldour P.S. Case No. 177 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 161.025 litres of foreign liquor has been recovered from the Bolero Vehicle.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing has been recovered from the possession of the petitioner. He further submits that the petitioner is neither the owner nor the driver of the alleged vehicle. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge, Excise II, Khagaria, in connection with Beldour P.S. Case No. 177 of 2023.

The petitioner is directed to mark his attendance in Kusheshwar Asthan police station on 1st Sunday of every month.
