JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-07-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged by the informant that all the F.I.R named accused persons including the petitioner shot fire at the husband of the informant, as a result of which, he sustained gunshot injuries and died.
Patna High Court CR. MISC. No.68114 of 2022(3) dt.17-07-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner and the specific accusation of shot fire upon the husband of the informant is against Raj Kumar Mandal and petitioner has been implicated in this case because he is son of Raj Kumar Mandal and was one of the members of the mob. The petitioner is languishing in custody since 13.06.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions
