2. Earlier prayer for bail of the petitioner was refused by this Court vide order dated 22.3.2022.

3. It is submitted on behalf of the petitioner that trial court's report dated 30.11.2023 reveals that case is pending for evidence and out of five chargesheet prosecution witnesses, only one has been examined so far. Petitioner is in custody since 28.6.2019 and there is no likelihood of conclusion of the trial in near future.

4. Considering the period of custody of the petitioner and tardy progress of the trial, let the petitioner as named above be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge XII, Gaya in Excise case no. 375 of 2019 corresponding to NDPS Case No. 44 of 2019.
