1. Heard learned counsel for the appellant and learned Special P.P. for the State, Ms. Usha Kumari No. 1.

2. The learned counsel for the appellant, after some arguments, seeks permission to withdraw the appeal with liberty to surrender and seek regular bail.

3. Permission is accorded.

4. It is made clear that the learned Trial Court while considering the regular bail application of the appellant shall keep in mind that though there is allegation of indiscriminate firing, but then only one empty cartridge was recovered and no one was injured in the occurrence, further the learned Trial Court shall not be prejudiced by the fact that appellant, before
