The petitioner is apprehending her arrest in connection with Janta Bazar P.S.Case No.124 of 2019 registered for offences punishable under Sections 304(B) and 201 of the Indian Penal Code.
As per FIR, the petitioner is said to be mother-in-law of the deceased and it is stated that the petitioner and her son has set her on fire and disposed of the dead body without informing the informant and others.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against this petitioner and even no case is made out under Section 304B of the IPC as a matter of fact the marriage was solemnized in the year, 2011. Father-in-law of the deceased has been granted
Patna High Court CR. MISC. No.61964 of 2019(3) dt.07-11-2019 2/2 anticipatory bail.
Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the materials in the case diary discloses that specific allegation is against the petitioner and her son.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail.
With the aforesaid direction, this application is dismissed.
