JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Laheria Sarai P.S. Case No. 97 of 2017, registered under Sections 341, 323, 325, 354 and 379/34 of the Indian Penal Code. The accusation is that early in the morning of 13.03.2017, petitioner Shyam Sah, who is the neighbour of informant, Gayatri Devi, entered in her house in absence of her husband and tried to tear her cloths with bad intention. On protest made by the informant this petitioner caused injury at her neck and also snatched her Mangalsutra.

Learned counsel for the petitioner submits that, in fact, petitioner is the own brother of Tulsi Sah, husband of the

Patna High Court Cr.Misc. No.39614 of 2017 (4) dt.13-12-2017 informant, and the dispute arose due to D.J. sound, in which, scuffle took place, in which, informant fell down and sustained injury at her mouth.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Laheria Sarai P.S. Case No. 97 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
