The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 18.675 litres of foreign liquor were recovered from the possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 24.05.2017. Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released

Patna High Court Cr.Misc. No.38456 of 2017(2) dt.19-08-2017 2/2 on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Rail (Muz) P.S. Case No. 61 of 2017 with a condition that one of the baillors will be the resident of Bihar since the petitioner belongs to West Bengal. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
