2. The petitioner apprehends his arrest in connection with Baheri P.S. Case No. 54 of 2024 registered for the offence under Sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner is involved in the murder of the deceased.
4. Learned counsel for the petitioner submits that the petitioner is not the assailant of the deceased and therefore he may be granted anticipatory bail.
5. Learned counsel for the informant submits that the pistol, which was used in the killing of the deceased belong to the petitioner and the petitioner has entered into a conspiracy
Patna High Court CR. MISC. No.70968 of 2024(4) dt.09-02-2026 2/2 for killing the deceased. He further submits that the process under Section 82 and 83 of the Cr.P.C. has already been issued against the petitioner and the petitioner does not deserve anticipatory bail.
6. Considering the allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this application for anticipatory bail is dismissed.
8. The petitioner is directed to surrender in the Court below within four weeks from today and pray for regular bail failing which the Superintendent of Police, Vaishali will take all steps for arrest of the accused person/s including the petitioner within four weeks.
9. Let a copy of this order this order be communicated to the Superintendent of Police, Vaishali through FAX for its compliance.
