The petitioner in the present case is seeking regular bail in connection with Guthni P.S. Case No. 76 of 2019 registered under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Siwan.

Learned counsel for the petitioner submits that petitioner has committed no offence and has falsely been implicated in this case due to previous enmity. Learned counsel submits that there is no allegation of repeated assault which shows that there was no intention to kill the informant. Learned A.P.P. for the State has opposed the prayer for bail.

No.65521 of 2019(3) dt.17-12-2019 2/2 Considering the facts and circumstances of the case wherein as per allegation petitioner had given a sharp cut injury on the head of the informant which has been found to be grievous in nature and presently the petitioner has been in custody since 26.08.2019, at this stage this court is not inclined to grant regular bail to the petitioner. Petitioner may, however, renew his prayer for bail after a reasonable period.
