2. The petitioner seeks regular bail in connection with Amhara P.S. Case No.26 of 2024 registered for the offences punishable under Sections 363 & 366 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is that he seduced and took away the wife of the informant from her house.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. During the investigation, except the statements of hear-say witnesses of the occurrence, nothing has come against the petitioner. The victim is a married woman aged about 35 years

Patna High Court CR. MISC. No.73389 of 2024(4) dt.17-12-2024 2/2 and the allegation of compelling her for marriage with the petitioner is an after-thought. There is no allegation of any sexual harassment against the petitioner. The investigation is completed and charge-sheet has already been filed against the petitioner in this case. The petitioner is in jail custody since 28.06.2024. The petitioner has no criminal antecedent and he undertakes to co-operate in the trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai / Concerned Court in connection with Amhara P.S. Case No.26 of 2024.
