2. The present application has been filed for quashing the entire prosecution of Complaint Case No. 1195© of 2009 registered under Section 420 of the IPC and Section 138 of the N.I. Act which is pending in the Court of learned Judicial Magistrate 1st Class, Patna.

3. The complaint case was filed for bouncing of cheque of Rs. 5,41,006/-.

4. Today, the learned counsel for the petitioner has produced a demand draft of Rs. 5,41,006/- which has been accepted, on instruction, by the learned counsel for the opposite party no.2. The petitioner has paid the amount and the opposite party no.2 has accepted the same.

5. Nothing remains in this case, therefore, this application is allowed. The entire prosecution of the petitioner in Complaint Case No. 1195© of 2009 is hereby quashed. (Sandeep Kumar, J) Guddu/- U
