The petitioner seeks bail in a case instituted under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act. It is alleged that while the informant was going to fodder his cow at his home, in the meantime, the petitioner along with other co-accused came and fired upon him due to which the informant sustained injury on his head and stomach. Thereafter he was brought to hospital for his treatment.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application. This is 3rd attempt for bail on behalf of the petitioner. A report was called for from the trial Court regarding
Patna High Court Cr.Misc. No.40183 of 2017 (3) dt.22-11-2017 2/2 the stage of the case. It has been reported that the trial is expected to be concluded by December, 2017. The prosecution witnesses have already been examined.
Considering the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in Industrial P.S. Case No. 07 of 2009, G.R. No.365 of 2009, S.Tr. No. 523 of 2015, pending in the court of learned Additional Sessions Judge-I11, Bhagalpur.
The Trial Court is directed to conclude the trial as early as possible.
