2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 108 and 3
(5) of the B.N.S.

The allegation in the first information report is that the husband of the informant committed suicide by consuming poison as the accused persons named in the first information report including the present petitioners had refused to return the money due to him. They also abused and threatened to falsely implicate him.

It is submitted by learned counsel for the petitioners that a bare perusal of the first information report would show that there is general and omnibus allegation against all the accused persons including the petitioners that they had given their land for cultivation to some other person instead of informant's husband and also refused to return his money, which caused extreme mental hardship to the husband of the informant due to which he committed suicide by consuming poison. It also appears from the first information report that on 14.07.2025, in the night, he had started shouting that he had consumed poison with regard to which a video recording was done.
It is mentioned in para-42 of the case diary as also in the order of the learned Sessions Judge that there is specific allegation against one Dhiraj Kumar Ram of having taken money from him and given his land to another person. It is also submitted that no case under Section 108 of the B.N.S. would be made out in the facts and circumstances of the present case as there is no strong and proximate link to connect the petitioners in the act of committing suicide by the deceased.

6. Taking into consideration the facts and

No.66040 of 2025(2) dt.19-09-2025 3/3 circumstances of the case and also considering the fact that the materials available on record are not sufficient to show that on account of any act of the petitioners, the deceased was left with no other remedy but to commit suicide in order to constitute an offence under Section 108 B.N.S., coupled with the fact that Dhiraj Kumar Ram against whom there is specific allegation of taking money has already surrendered and is in custody, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Rajpur P.S. Case No.242 of 2025, subject to the condition as laid down under 482 (2) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
