JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hussainganj (M.H. Nagar) P.S. Case No. 225 of 2019 registered for the offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR on confidential information police seized Scorpio vehicle and from which 518.400 litres of foreign liquor have been recovered and nobody is named any person. It appears that name of petitioner transpired during course of investigation.

Submission of learned counsel for the petitioner is that except confidential information of the police there is nothing against the petitioner and he has no criminal antecedent. Heard learned APP also.

No.61990 of 2019(2) dt.27-09-2019 2/2 In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender and on surrender learned Special Judge shall verify from the case diary as to what are the materials against the petitioner except confidential information of police and if there is no material against him, the court below shall release the petitioner on bail to its own satisfaction and if there is material against the petitioner, he has to pray for regular bail. With the above observation, this application is disposed of.
