Versus

The State of Bihar ... ... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s :

Mr.Anil Kumar, Adv.

For the Opposite Party/s :

Mr.Nirmala Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-04-2023 Heard learned counsel for the petitioner as well as learned APP for the State.

In this case, the petitioner is seeking regular bail in connection with Sandesh P.S. Case No. 338 of 2020, registered for the offences punishable under Sections 147, 148, 149, 447, 448, 504, 506, 307 of the Indian Penal Code and 27 of the Arms Act.

The informant made an allegation that the accused persons named in the FIR came to her house, they pressurized her to withdraw the previous case lodged against him and they also pressurized to obtain her signature on blank paper. On denial, the petitioner fired shot on her. She was referred to PMCH.

Patna High Court CR. MISC. No.71119 of 2022(5) dt.19-04-2023 2/2 The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The nature of injury has not been mentioned in the injury report as it is reserved awaiting the X-ray and CT scan reports.

On the other hand, the learned APP has opposed the prayer for bail.

The injured/informant is a lady. The accused persons were making pressure on her to withdraw the earlier case. The petitioner fired shot on her and the injury report shows that she sustained firearm injury. There are two criminal cases against the petitioner except the present one. Considering the above mentioned facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, it is rejected.
