1. Heard learned counsel for the Petitioner and learned APP for the State

2. The Petitioner apprehends his arrest in connection with Bagaha P.S. Case No. 479 of 2022 dated 06.07.2022 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

3. The main submissions advanced by learned counsel for the petitioner are that as per the allegation, this petitioner supplied steel almirahs and jugs of below standard to several schools but the said allegation is completely false, in fact the petitioner supplied the said articles in the year 2018 as per the terms and conditions of the tender and after supplying the same, any objection was not raised for a long period but after several years the FIR was lodged in the year 2022 by a private person against several contractors including this

No.72567 of 2023(2) dt.09-11-2023 2/2 petitioner and they have been made accused jointly in the FIR and moreover, many co-accused persons have been granted anticipatory bail by different Benches of this Court, of which details has been given in para 12 of the petition and the petitioner's case stands on similar footing with them.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

5. Considering the above submissions and mainly the petitioner's case being similar to other co-accused persons who are on bail as stated above, this Court is inclined to accept the petitioner's prayer for anticipatory bail. Accordingly, let the petitioner named-above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Bagaha P.S. Case No. 479 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shailendra Singh, J) annu/- U T
