Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Teghra P.S. Case No. 177 of 2022 registered for the offences punishable under Sections 406, 419, 420, 468 and 34 of the Indian Penal Code.

As per the prosecution, the police personnel on secret information apprehended this petitioner along with other coaccused persons and recovered 1.800 kg of metal which they projected as gold from their possession.

No.66756 of 2022(2) dt.16-03-2023 2/3 The main submissions advanced by petitioner's counsel are that though the petitioner is named in the FIR but he was simply alleged to be present along with other co-accused persons who are named in the FIR and the co-accused persons kept the petitioner involved in the alleged act with an intention to give some money to the petitioner and the alleged gold like metal was recovered from the possession of the co-accused Raju Kumar Thakur and there is no allegation of cheating against the petitioner and as per the FIR the co-accused persons Raju Kumar Thakur, Md. Amzad, Aman Kumar and Md. Kurban were involved in cheating the bonafide customers on the pretext of alleged gold type metal. Further submission is that the coaccused persons namely, Aman Kumar and Md.

Kurban, against whom there is more serious allegation in the FIR than that of the petitioner, have been granted bail by different co-ordinate Benches of this Court vide orders passed in Cr. Misc. No. 47330 of 2022 and Cr. Misc. No. 48799 of 2022. Further submission is that the petitioner is a student of B.Pharma and has been languishing in jail since 24.06.2022 and against him the investigation has been completed.

Learned APP appearing for the State has opposed the prayer for bail.

Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Teghra P.S. Case No. 177 of 2022.
