JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-10-2019 The petitioners have filed this writ petition against the order dated 11.05.2018 (Annexure-1), passed by the Additional Collector, Supaul in Jamabandi Cancellation Case No.36/2017, 04/17-18.

In view of the provisions as contained in Section 9(6) (a), the appeal lies against the order passed by the Additional Collector in Jamabandi Cancellation Case before the Collector but the petitioners have not exhausted the alternative and efficacious remedy and presented this writ petition.

Patna High Court CWJC No.19973 of 2019(2) dt.14-10-2019 2/2 After some arguments, the learned counsel for the petitioners seeks permission to withdraw this writ petition to file appeal before the Collector, Supaul.

Prayer is allowed.

The writ petition is disposed of with a direction to the Collector that if such appeal is filed by the petitioners within 30 days from the date of this order, the Collector, Supaul shall hear the appeal on merit and dispose of the same within six months from the date of presentation of the appeal.

With the aforesaid direction, the writ petition is disposed of.
